Village of Yates City Board met June 27.
Here are the minutes provided by the board:
Call to Order 6:02pm
Roll Call – Ehens, Brinker, Kinzer, Mahr, Smith, Lekies, Hostetler.
Attendance – Joy Mahr, Molly Richerson, Bruce Brinker
Citizens to address the Board.
Bruce Brinker wished to discuss the culvert on S Marietta street and Mark advised Bruce to discuss this topic when we get to it on the agenda.
Discuss/Approve retaining Miller, Hall & Triggs as Village Attorney in light of Miller, Hall & Triggs officially representing the State of Illinois for Eminent Domain state cases.
Dude to a possible conflict of interest between the Village and our legal representative, Miller, Hall & Triggs (known as MHT moving forward), the village has the option of retaining MHT by signing a Waiver. The Board agrees that this will more than likely never be an issue as their representation will be outside our area and if there was ever a conflict in the future, then the Village will seek outside council if need-be.
The Village approved signing the Waiver.
Motion Ehens, Second Smith.
Discuss/Approve the cancellation of pursuing an Intergovernmental Agreement with the Park District which would clarify the Village’s authority to use the Village’s police department to patrol and enforce Village ordinances and State/Federal laws at Heritage Park.
Mark was informed by the Park Board President that the Park Board is almost done addressing any concerns on this matter. A resolution is shortly coming.

Discuss/Approve replacing a culvert at 300 block of S Marietta Street
Brian Efnor, Village employee met with a representative of the residence of 300 block of S Marietta Street and determined the likely cause of the excess water emitting from the home’s basement sump pump was backflow of the outside water returning back to the basement sump pit. Mark was in direct contact with a representative of said residence and was informed that they will address the issue very soon. Once they complete this work, the Village will fill the drainage ditch with more dirt to align the elevation with the culvert to prevent future water drainage from pooling.
Bruce Brinker, Village employee, met with Oscar Kinzel (owner of Kinzel) to discuss the culvert and water pooling on the Heritage Park area. Oscar ran a line through the culvert and determined there was no blockage. However, being a concrete culvert, it is in 3’ sections and there is always some shifting that can happen as evidence of two small divots on the pavement above the culvert. With the flow of water being visually evident and the lack of any blockage, Oscar advised that the culvert is fine, albeit being old and some joints misaligning.
Oscar then addressed the Heritage Park water issue using a laser to grade the elevation. It was determined that there are points along their drainage ditch that were higher than the discharge culvert. A copy of this report will be forwarded to the Park Board for their consideration by Mark.
No Motion was made to replace the culvert.
Discuss/Approve replacing the fire hydrant north of the water tower for an amount not to exceed $4200 to Main & Core for a new hydrant and for the amount of $2000 to Kinsel for labor to replace it.
Main & Core quoted a new fire hydrant and additional parts at $3829. However, we are not sure which size hydrant we need and are investigating the depth of the current hydrant to determine this, but if the hydrant is larger than the quote, it should not increase the price by over $200.
The Village approved purchase of new fire hydrant and Kinsel’s labor to replace it. Motion Smith, Second Ehens.
Discuss/Approve piping the new well water for the well flushing process to the treatment plant for the amount not to exceed $20,000 with a charge not to exceed $1500/day exceeding four days for equipment rental.
Mark presented current budget number for the new well project. Through the loan agreement, there is a Contingency Cost allotted to the Village of $36,203.70. Of this, $2,840.00 was used for extended piping needed by Albrecht for the well, leaving $33,363.70. Deducting $20,000 from our Contingency Fund would leave the Village with $13,363.71 left. This amount of $13,363.71 will actually be higher as Mark was informed that our Engineering Inspection costs came in under budget.
