A. MOTION TO APPROVE THE CONSENT AGENDA THAT INCLUDES THE FOLLOWING ITEMS:

2. THE ACCOUNTS PAYABLES DATED JULY 31, 2025
3. THE MINUTES FROM THE NOVEMBER 6, 2024 EXECUTIVE SESSION MEETING
4. THE MINUTES FROM THE MARCH 5, 2025 EXECUTIVE SESSION MEETING
5. APPROVE THE USE OF CENTRAL PARK FOR A CELEBRATION OF LIFE ON AUGUST 9TH FROM 12 PM TO 7 PM
6. APPROVE THE USE OF THE MUNICIPAL PARKING LOT BY PRAIRIE STATE WINERY ON AUGUST 22, 2025 FROM 7 AM – 10 PM
Prairie State Winery would like to use the Municipal Parking Lot from 7 AM to 10 PM on August 22nd to host an event for their wine club members. The Winery intends to have music in the parking lot along with food and their slushie machine available. The Winery will be roping off the area and only allowing one entrance where wrist bands and guest check-in will be required. Wine members will be picking up their wine subscription which may be opened at the event and the slushie machine will be available but the Winery doesn’t intend to serve additional wine. The event will take place from 6:30 PM to 9:30 PM, however, the Winery would like to reserve the parking lot for the entire day to avoid any cars remaining parked in the parking lot during their event.
7. APPROVE THE EXPENSE OF AN NPDES PERMIT FROM THE USEPA, NOT TO EXCEED $10,500
NPDES stands for National Pollutant Discharge Elimination System. This is a permit the City must obtain every year from the Environmental Protection Agency. Although obtaining this permit is standard for daily operations, the cost exceeds $10,000 and therefore requires Council approval.
8. APPROVE AND AUTHORIZE THE PUBLIC WORKS DIRECTOR TO PURCHASE CHEMICAL TANKS AND RADARS FOR THE IRON FILTRATION FACILITY FROM HAWKINS CHEMICAL GROUP, NOT TO EXCEED $11,452.24
This equipment is for the containment of chemicals at the Water Treatment Facility and is required to meet IEPA regulations.
9. APPROVE A STIPULATED AGREEMENT 2382 WITH THE STATE OF ILLINOIS COMMERCE COMMISSION AND CANADIAN PACIFIC FOR SAFETY IMPROVEMENTS TO THE CANADIAN PACIFIC RAIL LINE AT BROWN STREET
In order to complete work at this rail crossing, the City is required to enter into an agreement with the State of Illinois and Canadian Pacific Railroad. The ICC has explained that the improvements are related to the installation and upgrade of older devices and railroad equipment with modern control equipment and warning devices and the addition of one pedestrian gate. This project is at no cost to the City
VII. NEW BUSINESS
A. UPDATE ON 2025 STREET FUNDING PRESENTATION AND SURVEY
B. APPROVE AN ORDINANCE APPROVING VARIATIONS FROM THE CITY OF GENOA UNIFIED DEVELOPMENT ORDINANCE FOR PROPERTY COMMONLY KNOWN AS 365 SOUTH HADSALL STREET (JURSICH APPLICATION)
The City of Genoa received an application from Sean Jursich, as Petitioner, and Jodace Inc, as property owner for a variance request at 365 South Hadsall Street to allow for a chain link fence 8’ in height at all property lines. Notice was provided prior to a Public Hearing on July 17th. At the meeting, after discussion and cooperation from the petitioner, the Plan Commission unanimously recommended to the City Council approval of the variance with conditions that include creating a setback from the east property line for the fence as well as reducing the fence height that runs north and south on the east end of the property.
C. APPROVE AN ORDINANCE AMENDING THE ANNUAL BUDGET FOR THE FISCAL YEAR BEGINNING MAY 1, 2024 AND ENDING APRIL 30, 2025 FOR THE CITY OF GENOA, DEKALB COUNTY, ILLINOIS
After each budget year, the City is required to amend the budget when expenditures or revenues in a fund exceed the amount budgeted in that fund. For Fiscal Year 2024-2025, that includes the following relative to funds that exceeded budgeted expenditures: Derby Estates SSA Fund (additional pond maintenance), Equipment Replacement Fund (purchased a Public Works Truck one year early due to equipment failure and a non-budgeted replacement tornado siren was purchased), Police Pension Fund (refund of pension benefits upon separation of employment). Further, there are 2 transfers from operating funds into capital funds: $150,000 transfer from the General Fund to the Street Improvement Fund and $300,000 from the Water and Sewer Operating Fund to the Water and Sewer Capital Fund.
D. APPROVE A RESOLUTION OBJECTING TO THE ISSUANCE OF A SPECIAL USE PERMIT TO SUNVEST SOLAR, LLC TO ALLOW A 5-MEGAWATT COMMERCIAL SOLAR FACILITY AT THE SOUTHEAST CORNER OF STATE ROUTE 72 AND PLEASANT HILL ROAD
SunVest Solar, LLC has submitted a request to DeKalb County for a Special Use Permit for property located at the southeast corner of Route 72 and Pleasant Hill Road. A Public Hearing was held on July 24, 2025, before the DeKalb County Hearing Officer. However, the hearing was continued because the Petitioner did not notify the City as required by County Ordinance, since the property lies within the City’s 1.5-mile planning area.
As part of the 2023 Comprehensive Plan and Land Use Map update, community stakeholders identified this property within the City’s planning area as intended for future residential development. Although the property is outside City limits—and therefore outside the City’s decision-making authority—the City Council may submit a formal objection to the project since it is inconsistent with the City’s Land Use Map. The final decision will be made by the DeKalb County Planning, Zoning, and Development Committee.
