A. Approve An Ordinance Levying Taxes For All Corporate Purposes For The City Of Genoa, Dekalb County, Illinois, For The Fiscal Year Commencing On The 1st Day Of May, 2023 And Ending On The 30th Day Of April, 2024.

B. Approve An Ordinance Levying Special Service Area Property Taxes For The Special Services To Be Provided In The River Bend Special Service Area In The City Of Genoa, Dekalb County, Illinois For The Fiscal Year Commencing On The 1st Day Of May, 2023 And Ending On The 30th Day Of April, 2024.

C. Approve An Ordinance Levying Special Service Area Property Taxes For The Special Services Provided In Derby Estates Special Service Area In The City Of Genoa, Dekalb County, Illinois For The Fiscal Year Commencing On The 1st Day Of May, 2023 And Ending On The 30th Day Of April 2024.

D. Approve An Ordinance Levying Special Service Area Property Taxes For The Special Services To Be Provided In Genoa Oak Creek Estates Unit Four Special Service Area In The City Of Genoa, Dekalb County, Illinois For The Fiscal Year Commencing On The 1st Day Of May 2023 And Ending On The 30th Day Of April, 2024.

E. Approve An Ordinance Abating The Tax Heretofore Levied For The Year 2023 To Pay The Principal And Interest On $2,500,000 General Obligation Bonds, Series 2020, Of The City Of Genoa, Illinois

F. Consent Agenda By Omnibus Vote

1. Motion Of Unanimous Consent Of The City Council For Use Of An Omnibus Vote To Approve The Consent Agenda

2. Motion To Approve The Consent Agenda That Includes The Following Items:

a. Award A Bid For Sewer Lining With Insituform Technologies, Not To Exceed $46,164.50

b. Approve A Façade Grant Agreement With Prizm Real Estate Investments, Llc For 105 South Emmett Street, Not To Exceed $30,000

c. Approve An Intergovernmental Agreement With The Village Of Maple Park And The City Of Genoa

This agreement allows the Village of Maple Park to hold their own Administrative Adjudication at Genoa’s City Hall. Maple Park will pay their own attorney and bailiff as well as contract with the Administrative Adjudication Hearing Officer separately. There are no direct costs associated with allowing Maple Park to hold their hearings at Genoa’s City Hall and currently, Cortland, Kingston, and Kirkland also hold their hearings at Genoa’s City Hall.

d. Approve An Amendment To The Grant Agreement Between The State Of Illinois Department Of Commerce And Economic Opportunity And The City Of Genoa

This agreement pertains to the City’s RISE Grant awarded for a housing study in 2022. This amendment modifies the term of the agreement from 12/31/2023 to 3/31/2024. The purpose of the extension is to allow for additional time to complete the Housing Study, following the adoption of a Comprehensive and Strategic Plan in early January. Additional time may also allow for a notice of funding opportunity to be published by DCEO for implementation grants to ensure that the solutions proposed in the housing study will be eligible for implementation grant funding.

e. Approve A Permitted Use And Maintenance Agreement With Ampler Development LLC

Under the Planned Unit Development approved earlier this year, Ampler Development (Taco Bell franchise owners) is required to install a sidewalk along Route 72 fronting their development. In order to obtain a permit for this construction, IDOT is requiring the City to maintain the sidewalk. In turn, the City is requiring that Ampler maintain the sidewalk that serves their development. The agreement within this agenda item outline’s Ampler’s maintenance responsibilities.

f. Approve A Letter Of Understanding With The Illinois Department Of Transportation Relating To A Sidewalk Along Route 72

This Letter of Understanding describing the maintenance responsibilities of a proposed sidewalk requires City approval in order for the Developer referenced above to obtain a permit for construction of the proposed sidewalk.

g. Ratify A Stormwater Management AGREEMENT

This agreement was recorded with the Plat for the new Taco Bell to clarify language that was included in the plat. The agreement clarifies that the City has no obligations to maintain the stormwater drainage or facilities withing the easement dedicated on the Plat.

h. Approve An Amendment To The City’s Personnel Policy

H. Approve An Ordinance Adopting Title 1 Of The Municipal Code Of The City Of Genoa

This Ordinance, if approved, replaces the current Title 1 of the Municipal Code. Changes are reflected in a tracked word document also included in the packet. These changes are recommended as they reflect how the City currently operates, clarify the intent of existing ordinances, or bring the Code into compliance with State Law. Staff has reviewed this with our consulting Attorneys and will bring additional recommendations to the remaining Titles of the Municipal Code to the Council in the coming months.

I. Approve An Ordinance Amending Appendix A Of The Municipal Code Of The City Of Genoa

The amendments in this ordinance pertain to the changes recommended in the Title 1 ordinance - removing fines and fees from 1-4-1 of the Municipal Code and instead placing them in Appendix A with other fines and fees. The fine and fee amounts have not been increased or decreased, this is a formatting change within the Code.
