City of Carbondale Local Liquor Control Commission met Sept. 11.

Meeting called to order at 6:00 PM

Action: 2.1 Approval of Minutes from the Local Liquor Control Commission Meeting of August 13, 2019

MOTION: Approve the minutes from the Local Liquor Control Commission meeting of August 13, 2019

Motion by Carolin Harvey, second by Lee Fronabarger.

Action: 2.2 Approval of the Change in Ownership of Stix Bar LLC d/b/a Stix at 517 South Illinois Avenue

Alfred Sanders, attorney for Greg Knoob, was present to respond to questions from the Liquor Commission; Lawrence Greer, one of the two new manager/members was also present to respond to Commission inquiries.

The Commission inquired about the liability for the pending appeals, whether a request can be made for the sales contract, whether there were plans to make changes to the operation, the anticipated reopening date, whether there was any documentation which was missing or lacking, particularly as the letter approving the change in managers/members was so brief, and asked if Mr. Knoob would be out of the picture entirely. Further, the Commission noted that the new members/managers would be held accountable to the license’s history of liquor violations, asked the new member/manager if they were aware of those implications – noting that a progressive discipline structure is implemented, and indicated an interest in receiving more complete information for these cases.

Lawrence Greer noted that Mr. Knoob had submitted the bond payments which should address the liabilities, stated that he was aware of the implications of the history of violations, indicated that they were in the process of upgrading the facility and cleaning, that a reopening would occur once the transactions were completed, and denied that Mr. Knoob would have any involvement with the business.

Alfred Sanders indicated that the bonds submitted by Mr. Knoob were for all fines and court costs; offered clarification regarding Mr. Knoob’s continuing involvement, noting that he still owns the building itself; stated that the renovations would be handled by the new member/managers; and stated that no written contract currently exists.

City Attorney Snyder stated that the Commission could submit a request for whatever documentation they require to make the decision as to whether this constitutes a bonda fide sale.

Donald Monty suggested that the City Council will need to consider how to address situations where all members of an LLC are replaced, but the LLC still retains ownership of the license, and should transfers should be removed from the Code, that each of these changes would be treated as new ownership.

MOTION: Approve the Change in Ownership of Stix Bar LLC contingent upon receipt of outstanding items and confirmation of a bona fide transfer, such determination to be made by the City Attorney.

Motion by Adam Loos, second by Tom Grant.
