A Local Liquor Control Commission meeting preceded the City Council meeting.

5. Preliminaries to the City Council Meeting

5.1: Roll Call

5.2: Council Comments, General Announcements, and Proclamations

September 11, 2018 is proclaimed as a Day of Service and Remembrance.

A presentation was given to honor Mr. Harvey Welch, Jr. for his 40 plus years of service on various boards and commissions.

Councilman Kang announced the birth of City Manager Gary Williams’ baby girl.

Councilwoman Bradshaw announced a yard sale to benefit the Women’s Center on Friday, September 14 and Saturday, September 15, 2018. She also announced the rescheduled date for the SIU Arena yard sale which will be Saturday, September 22, 2018 and the Science Center annual fundraiser to be held on Saturday, September 22, 2018.

5.3: Citizens’ Comments and Questions

Carly Copeland, Prevention Educator at the Women’s Center and committee member for Non- Violent Carbondale, announced the 11 days of peace which will be observed from September 21 to October 1, 2018, and the 70th anniversary of the Universal Declaration of Human Rights celebration to be held on Tuesday, October 2, 2018, at the University Museum.

Jerrold Hennrich, 610 West Sycamore Street, Chair of the Human Relations Commission invited everyone to the Human Relations Commission roundtable discussion to be held on Thursday, September 13, 2018, at the Carbondale Civic Center.

7.1: Approval of Minutes from the City Council Meeting of August 28, 2018

Resolution: Approve the minutes of the regular City Council meeting from August 28, 2018

7.2: Approval of Warrant for the Period Ending: 08/13/2018 for the FY 2019 Warrant 1336 in the Total Amount of $823,051.07

Resolution: Accept the following report of payments made for the period ended: 08/13/2018 totaling $823,051.07 (Exhibit A-09-11-2018)

7.3: Acceptance of Two (2) Deeds Granting Permanent Easements Located at 207 & 209 South Illinois Avenue

7.3: Acceptance of Two (2) Deeds Granting Permanent Easements Located at 207 & 209 South Illinois Avenue

Councilman Doherty asked what Capital Improvement Project this item falls under and the estimated cost of the project. Public Works Director Sean Henry stated that this falls under the Illinois Avenue Streetscape project and documentation of the cost is not available at the moment.

Councilman Doherty also expressed his concern about the project being completed on private property before the easements have been accepted and inquired about the legality of the process. City Attorney Jamie Snyder addressed his concerns.

MOTION: Accept two (2) Deeds granting Permanent Easements located at 207 & 209 South Illinois Avenue

7.5: Award the Purchase of three (3) Police Vehicles to Vogler Ford of Carbondale, Illinois in the amount of $104,241, Approve an Ordinance Approving a Budget Adjustment to Increase the Police Department's FY2019 Budget in the amount of $104,241, and Declare City Owned Property as Surplus (Exhibit B-09-11-2018; Ordinance 2018-33)

Jerrold Hennrich, 610 West Sycamore Street, asked what declaring city owned property as surplus means. City Attorney Jamie Snyder addressed his inquiry.

MOTION:

1. Award the purchase of three (3) 2018 Model, Police Package Utility Vehicles to Vogler Ford, of Carbondale, Illinois, in the amount of $104,241.00.

2. Approve an Ordinance authorizing a budget adjustment increasing the Police Department’s FY2019 budget in the amount of $104,241.00.

3. Declare the 2010 Ford Crown Victoria (VIN# 2FABP7BV0AX134795) and the other 2010 Ford Crown Victoria (VIN# 2FABP7BV4AX134797) as surplus property.

Motion by Jeff Doherty, second by Adam Loos.

8. General Business of the City Council

Action: 8.1 Ordinance Amending Title 6 of the Carbondale Revised Code to Allow Natural Burials at Oakland Cemetery and a Budget Adjustment of $29,000 to Establish a Natural Burial Area in Oakland Cemetery

(Exhibit C-09-11-2018; Ordinance 2018-35); (Exhibit D-09-11-2018; Ordinance 2018-36)

MOTION: Adopt an Ordinance amending Title 6 of the Carbondale Revised Code to allow Natural Burials in Oakland Cemetery and adopt an Ordinance increasing the FY2019 Budget by $29,000 to provide funds necessary to establish a Natural Burial area in Oakland Cemetery.

Motion by Tom Grant, second by Adam Loos.

Discussion: 8.2 City Council Discussion of Proposed Changes to Title 5 of the Carbondale Revised Code as it relates to Video Gaming

Video gaming information, statistics, and proposed changes to Title 5 as it relates to video gaming were compiled by City Staff for City Council review. Included in the report was a comparison of the City’s video gaming license fees to other surrounding municipalities, revenue gained from video gaming by the State and local establishments, potential revenue gained by the City should the video gaming fees be increased, and changing or maintaining the cap for video gaming terminals.

Council concerns and comments included increasing the fees more than what is proposed, establishing a basis for determining a cap for video gaming machines, keeping the current cap on machines as it is, and possibly increasing the cap of machines for establishments that holds a B3 liquor license since video gaming is their primary business. It was suggested that Council analyze the percentages of each revenue source for establishments with video gaming. That information can be a tool used to help determine the fees and the cap on the number of machines.

Don Monty, 418 South Giant City Road, and Jerrold Hennrich, 610 West Sycamore, both spoke in favor of maintaining the current cap of video gaming machines.
