VII. NEW BUSINESS
A. APPROVE A RADIO TRANSMITTER/RECEIVER SITE LEASE AGREEMENT WITH OPIQUAD, LLC This agreement is with Opiquad, LLC, formerly Fox Valley Internet. For several years, the company has leased space on the City’s water tower. The current agreement is coming to an end and for that reason, they have proposed updating the agreement. Two significant changes were made – increasing the notice for termination of the agreement from 60 days to 90 days prior to the term expiring and reducing the rent from $400 to $100 per month. While this is a significant decrease ($3,600 annually), the provider explained they have few more than a dozen clients at this time. That being said, Staff discussed non-renewal due to the decrease but determined that there are benefits to the company locating the equipment on the tower outside of lease payments, such as the company’s willingness to climb the tower if Public Works needed it. If approved, the revenue will be adjusted in the upcoming Fiscal Year budget. This agreement has been reviewed by the City’s consulting attorneys.
B. DISCUSS A REQUEST BY GCHVERT, LLC, AS PETITIONER AND PROPERTY OWNER, FOR APPROVAL OF A PETITION TO AMEND THE FINAL PLANNED UNIT DEVELOPMENT FOR UNIT 3 OF THE RIVERBEND SUBDIVISION TO ALLOW FOR THE CONSTRUCTION AND OPERATION OF TWO PICKLEBALL COURTS AT PROPERTY COMMONLY KNOWN AS 601 STEARN DRIVE On December 12, 2024, a Public Hearing before the Plan Commission was held to consider the request for two pickleball courts in the Riverbend Subdivision, adjacent to the Clubhouse and adjacent to the non-55+ single-family residential. The Staff Report and the Petitioner’s submittal documents are included in the packet. Minutes from the Public Hearing are also included in the packet. During the hearing, several residents objected to the proposed use. The Plan Commission voted unanimously to deny the request by the Petitioner. Based on the City Council’s feedback, an ordinance will be drafted and presented at a future Council meeting, tentatively January 22nd.
