STATE OF ILLINOIS ILLINOIS LABOR RELATIONS BOARD LOCAL PANEL

Minutes of the Local Panel Meeting Held on October 4, 2016

I. OPENING OF MEETING 10:00 —via videoconference at 100 West Randolph Street, Room 9-035, Chicago, Illinois and 131 West Mason, Room 104 Training Center, Springfield, Illinois.

II. PRESENT

Robert M. Gierut, Chairman; Charles E. Anderson, Member of the Board; Richard Lewis, Member of the Board; Anna Hamburg-Gal, Associate General Counsel; and staff members present in Chicago. Melissa Mlynski, Executive Director; Sarah Kerley, Deputy General Counsel; and staff present in Springfield.

III. APPROVAL OF MINUTES OF REGULAR MEETING HELD ON September 7, 2016

Chairman Gierut called for approval of the minutes of the September 7, 2016 meeting. Member Anderson moved to approve the minutes. Member Lewis seconded. The Board passed the motion unanimously, by a voice vote.

IV. EXECUTIVE DIRECTOR’S REPORT

Executive Director Mlynski presented the Executive Director report. The Chair and Members discussed the report.

V. BOARD ACTIONS

1. Case No. L-CA-14-035

Painters District Council No. 14/Chicago Transit Authority

Chairman Gierut called the case and asked Associate General Counsel Anna Hamburg-Gal to present the case to the Board. Associate General Counsel Hamburg-Gal stated that Administrative Law Judge (ALJ) Deena Sanceda issued a Recommended Decision and Order (RDO) alleging that the Respondent violated Sections 10(a)(4) and (1) of the Illinois Public Labor Relations Act (Act). She then discussed the exceptions and responses that were filed and informing the Board that The Charging Party’s response included a request for oral argument which she recommended that the Board deny. After her presentations, she made several alternative options for the Board to consider. After a detailed discussion, Member Lewis moved to deny the request for oral arguments. Member Anderson seconded the motion, and the Board passed it unanimously by a voice vote. Member Lewis then made a motion to accept the RDO with modifications. Member Anderson seconded the motion, and the Board passed it unanimously by a voice vote.

2. Case No. L-CA-16-020

Michael J. Conroy/City of Chicago (Fire Department)

Chairman Gierut called the case and asked Deputy General Counsel Kerley to present the case. Deputy General Counsel Kerley stated that ALJ Hamburg-Gal issued a RDO on failure to timely file an Answer to the Complaint for Hearing. She then presented and discussed the exceptions that were filed. After her presentation, she recommended that the Board accept the RDO. After discussion, Member Anderson moved to accept the ALJ’s RDO. Member Lewis seconded the motion, and the Board passed it unanimously by a voice vote.

VI. EXECUTIVE SESSION

After a short discussion regarding whether there was a need for executive session, the Board concluded it was unnecessary.

VII. PUBLIC COMMENT

No members of the public were present.

VIII. ADJOURNMENT

Chairman Gierut called for a motion to adjourn. Member Anderson made a motion to adjourn the meeting, and the Board passed it unanimously, by a voice vote.

Adopted and approved by the Chairman and Members of the Local Panel of the Illinois Labor Relations Board, in Chicago, Illinois, this 15th day of November, 2016.
